Terms of Service

1. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@fusionagents.ai if you suspect unauthorized access to your account.

3. The Service

Fusion Agents provides AI-powered digital employees ("Agents") that perform business tasks including but not limited to customer support, content creation, phone calls, CRM management, research, and administrative work. Agents are software programs — they are not human employees, contractors, or legal entities.

4. Subscriptions & Billing

The Service operates on a subscription basis with usage-based charges for AI processing, voice minutes, and media generation. All fees are quoted in US dollars.

2. 2Usage fees are calculated at the end of each billing cycle based on actual consumption.
3. 3All fees are non-refundable except as required by applicable law or as described in our SLA.
4. 4We reserve the right to change pricing with 30 days advance notice.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Generate, distribute, or store content that is illegal, defamatory, harassing, or harmful.
• Impersonate any person or entity or misrepresent your affiliation.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse-engineer, decompile, or disassemble any aspect of the Service.
• Use Agents for automated spam, phishing, fraud, or any deceptive practice.
• Overload or interfere with the Service infrastructure in a way that degrades performance for other users.

6. Intellectual Property

The Service, including all software, designs, trademarks, and documentation, is owned by Fusion Data Company. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. Content you create through the Service remains your property, subject to any licenses you grant us to operate the Service.

7. Data & Privacy

Our collection and use of personal data is governed by our Privacy Policy. You are responsible for ensuring that any data you provide to or process through the Service complies with applicable data protection laws.

8. Third-Party Services

The Service integrates with third-party providers including OpenRouter, ElevenLabs, and Fal.ai. Your use of these services through our platform is subject to their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Service Level Agreement

Business and Enterprise plan customers are covered by our Service Level Agreement, which defines uptime commitments and remedies for service disruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Fusion Data Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, arising from your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the fees you paid in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Fusion Data Company, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription from the dashboard or by contacting support. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted unless you request an export.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, United States. Any disputes will be resolved in the state or federal courts located in Clark County, Nevada.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
